Car Accidents in the Harrisburg Area

Harrisburg sits at the center of a busy transportation network used by commuters, commercial vehicles, state employees, visitors, and travelers crossing Pennsylvania.

Crashes can occur on major highways and heavily traveled roads as well as neighborhood streets and local intersections. You can see where serious crashes happen most often on our Pennsylvania car accident hotspots page.

Our attorneys handle cases involving:

  • Rear-end collisions
  • Intersection accidents
  • Highway crashes
  • Distracted drivers
  • Drunk or impaired drivers
  • Speeding and aggressive driving
  • Unsafe lane changes
  • Failure-to-yield accidents
  • Head-on collisions
  • Multi-vehicle accidents
  • Pedestrian and bicycle accidents
  • Hit-and-run crashes
  • Uninsured and underinsured motorists

How the collision occurred determines what evidence may be important and which parties or insurance policies may be involved. If a tractor-trailer or other commercial vehicle was involved, see our Harrisburg truck accident lawyers.

What Should You Do After a Car Accident?

If you’ve been involved in a serious crash, your health and safety come first. Seek appropriate medical attention and contact emergency services when necessary.

If circumstances allow, you should also:

  • Report the crash to police.
  • Photograph the vehicles and accident scene.
  • Obtain insurance and contact information from the other drivers.
  • Get names and contact information from witnesses.
  • Avoid arguing about fault at the scene.
  • Keep copies of medical bills, repair estimates, and other records.
  • Notify your insurance company of the accident.
  • Be cautious about giving recorded statements to another driver’s insurer.

Evidence can disappear quickly after a collision. Vehicles get repaired, surveillance recordings may be erased, and witnesses become more difficult to locate.

Who Pays for Injuries After a Pennsylvania Car Accident?

Pennsylvania’s automobile insurance system can make accident claims confusing.

The insurance coverage available after a crash depends on the policies involved, the injuries suffered, and the circumstances of the accident. Questions may arise concerning medical benefits, liability coverage, uninsured or underinsured motorist coverage, and the injured person’s right to pursue a claim against the at-fault driver.

Our attorneys review the available insurance policies and investigate who caused the accident before determining how a claim should proceed.

What If the Insurance Company Says You Caused the Crash?

Fault isn’t always obvious, and an insurance company’s initial conclusion isn’t necessarily the final answer.

Evidence such as photographs, vehicle damage, police reports, witness statements, surveillance footage, electronic vehicle information, and accident reconstruction may help establish how a collision occurred.

Pennsylvania’s comparative negligence rules can also become important when more than one party is alleged to have contributed to an accident.

If liability is disputed, don’t assume that an insurance company’s denial means you don’t have a case. Here is what aggressive representation actually looks like in a car accident case.

Injuries May Not Be Obvious Immediately

Some accident injuries are apparent at the scene. Others become more noticeable hours or days later.

Car crashes can cause:

  • Head injuries and concussions
  • Traumatic brain injuries
  • Neck and back injuries
  • Herniated discs
  • Shoulder injuries
  • Knee injuries
  • Broken bones
  • Internal injuries
  • Nerve damage
  • Scarring
  • Soft-tissue injuries

Seeking medical attention also creates documentation connecting your injuries and treatment to the accident.

What Compensation May Be Available?

Depending on the circumstances, a car accident claim may seek compensation for medical expenses, future treatment, lost wages, reduced earning capacity, pain and suffering, permanent disability, scarring, and other accident-related losses.

The value of a claim depends upon far more than the amount of vehicle damage.

A serious injury may affect someone’s ability to work, care for a family, participate in activities, or live independently long after the vehicle itself has been repaired. To see how a claim moves from start to finish, read what happens when you file an injury claim in Pennsylvania.

Harrisburg Car Accident FAQs

What if the driver who hit me has no insurance? You may be able to pursue a claim under the uninsured motorist (UM) coverage on your own auto policy, or in some cases on another policy that covers you, such as one belonging to a household family member. If the at-fault driver carries too little coverage, underinsured motorist (UIM) coverage may help.

I have limited tort. Can I still recover for pain and suffering? Possibly. Limited tort generally restricts pain and suffering claims, but exceptions exist, including cases involving a serious injury and certain crashes where the at-fault driver was convicted of DUI or accepted Accelerated Rehabilitative Disposition for it. An attorney can review whether an exception applies to your situation.

What should I do if the insurance company offers a quick settlement? Be careful. Once you accept a settlement and sign a release, you generally cannot reopen the claim, even if your injuries turn out to be worse than expected. It usually makes sense to understand the full extent of your injuries first.

What to Do After a Car Accident

Call the police

A police report is a necessary document for any personal injury claim arising from an auto accident. This will not only contain information regarding how the accident occurred and whether injuries were sustained, but also witness information that may be valuable in future litigation. If for some reason you do not call the police immediately, there is a form you can complete to file an accident report after it occurs, which can be found at the Pennsylvania Department of Transportation website: PennDOT Driver’s Accident Report (Form AA-600). If police did not investigate a crash that required a report, this form generally must be filed within five days.

Seek medical treatment

If you sustained an injury in the accident, even if you are not sure whether it is serious, you should seek immediate medical treatment and truthfully describe your symptoms to the person who treats you. They may take X-Rays, MRIs, or other diagnostic tests to determine whether you need treatment. It is common to receive a “sprain and strain” diagnosis, which the emergency room physicians may say should improve with rest and over the counter anti-inflammatories, such as ibuprofen. Hopefully, you will improve. However, if you continue to have problems after the initial visit, you should consider following up with your regular doctor or a specialist to see if the injury is more severe than the original diagnosis would indicate.

Detail the accident

After a crash, you may have a vivid recollection of exactly what happened, or you may not recall the events. Since memories may fade over time, it is helpful to draw the road or intersection where the accident occurred, including the position of the vehicles and any traffic lights or signs. If you recall what speed you were traveling, whether you saw the other driver on a cell phone, or anything else that you think may be important, writing it down can help refresh your recollection later on.

Call your insurance agent

Your car insurance will likely cover your initial medical bills, up to your coverage limit. You may also have wage loss and property damage coverage. It is important to contact your insurance company to open the claim and provide them with whatever information they need.

GET AN ESTIMATE

Obtaining repair estimates is not only helpful for your auto damage claim, but it also supports your claim regarding the severity of the accident and the location of impact. If you were rear ended at a traffic light, thousands of dollars in repairs for the back end of your vehicle could be persuasive.
