Why You Need to Call Before
Talking to Your Employer's Insurance

The workers' comp insurance adjuster who contacts you after your injury is working against you from day one. Here's what every injured PA worker needs to know.

01

Your employer's insurance works against you

The moment you report your injury, the insurance company assigns an adjuster whose job is to pay you as little as possible — or deny the claim entirely. They know workers' comp law inside out. You need someone who knows it better.

02

Anything you say can be used to deny your claim

Casual statements to your employer, supervisor, or their insurance adjuster can be twisted and used against you. Even saying "I'm fine" after an accident can cost you thousands. Call us before you say anything.

03

PA has strict reporting deadlines

In Pennsylvania you must report your work injury to your employer within 120 days — but the sooner the better. Delays give insurers ammunition to dispute your claim. Don't wait.

04

Denied claims can still be won on appeal

Insurance companies deny valid claims every day hoping workers give up. Most denied claims can be successfully appealed with the right attorney. If your claim was denied — call us immediately.

Every Benefit You're Entitled To Under PA Law

Pennsylvania workers' comp covers far more than most injured workers realize. We fight for every benefit — not just the obvious ones.

Full Medical Coverage

All reasonable and necessary medical treatment related to your work injury — doctor visits, surgery, physical therapy, prescriptions and more.

Wage Loss Benefits

If you can't work due to your injury, PA workers' comp pays 66⅔% of your average weekly wage — tax free — for as long as you're disabled.

Specific Loss Benefits

Permanent loss or loss of use of a body part — hand, arm, leg, hearing, vision — entitles you to additional compensation under PA law.

Disfigurement Benefits

Serious permanent disfigurement to your face, head or neck from a work injury entitles you to additional compensation in Pennsylvania.

Vocational Rehabilitation

If your injury prevents you from returning to your previous job, you may be entitled to retraining and job placement assistance.

Third-Party Claims

If someone other than your employer contributed to your injury — a contractor, equipment manufacturer, property owner — you may have an additional personal injury claim worth far more.

Workers' Comp Questions We Hear Every Day

Does it cost anything to hire Pisanchyn Law for my workers' comp case?

Nothing upfront — ever. Workers' comp cases are handled on a contingency fee basis, meaning we only get paid if and when we win your case. Our fee comes out of the recovery. If we don't win, you don't pay. Pennsylvania law also caps attorney fees in workers' comp cases, so you'll always know exactly what to expect.

My workers' comp claim was denied. Is it too late to fight it?

A denial is not the end — it's the beginning of the fight. Insurance companies deny valid claims hoping workers give up. You have the right to appeal a denial and request a hearing before a workers' comp judge. Most denials can be successfully appealed with the right legal representation. Call us immediately after a denial — there are deadlines you can't miss.

Can my employer fire me for filing a workers' comp claim?

Pennsylvania law prohibits employers from retaliating against employees for filing a workers' comp claim. If your employer fires you, demotes you, cuts your hours, or creates a hostile work environment because you filed a claim — that is illegal retaliation and you may have an additional legal claim. Call us if you believe you're being retaliated against.

What is an Independent Medical Examination (IME) and do I have to go?

An IME is an examination ordered by the insurance company — conducted by a doctor who is paid by the insurer. Despite the name, they are rarely truly "independent." These exams are frequently used to claim you've recovered when you haven't, in order to cut off your benefits. Under PA law you generally must attend, but you have rights. Call us before you go to any IME — we'll prepare you for exactly what to expect and how to protect yourself.

My employer says I'm an independent contractor — can I still file a workers' comp claim?

Possibly yes. Many employers misclassify workers as independent contractors specifically to avoid paying workers' comp coverage. Pennsylvania law looks at the actual nature of your work relationship — not just what your contract says. If you were told to show up at specific times, used company equipment, worked only for that employer, or were supervised by them, you may legally be an employee. Call us — this is a very common situation and we evaluate it for free.

Can I sue my employer for a work injury in Pennsylvania?

Generally no — workers' comp is the exclusive remedy against your direct employer in Pennsylvania. However, you may be able to file a separate personal injury lawsuit against a third party — a contractor, equipment manufacturer, property owner, or another company on the job site — who contributed to your injury. These third-party claims can be worth significantly more than workers' comp alone. We evaluate both claims in your free consultation.
